Sexual harassment: There are two types of sexual harassment—quid pro quo and hostile environment.
Quid pro quo refers to incentive-based sexual harassment. If a manager or supervisor tells you that you will receive a promotion by giving in to unwelcome sexual advances, they have engaged in quid pro quo sexual harassment. Quid pro quo only occurs when a supervisory authority grants or withholds job benefits in exchange for sexual favors.
A hostile environment is created when unwelcome physical contact, offensive materials and lewd comments or gestures have become part of a regular work day. Usually, an isolated incident will not be regarding as hostile environment sexual harassment. The behavior must be consistent. Contributors to a hostile environment can include managers, supervisors, co-workers and even regular customers.
Other areas of employment law include retaliation or wrongful termination for family leave, medical leave, workers’ compensation leave, military leave or for being a company whistleblower.
